NOTIFICATION

New Delhi, the 14th July, 1997

  GSR 404(E):- In exercise of the powers conferred by Section 5 of the Aircraft Act, 1934, the Central Government hereby makes the following rules further to amend the Aircraft Rules, 1937, namely:-

1.(1) These rules may be called the Aircraft (....... Amendment) Rules, 1997.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Aircraft Rules, 1937;

(1) In rule 30;

  1. in subrule (1), for the words "the date of registration", the following words shall be substituted, namely:-
  2. "the date of registration and the period of validity of such registration";

  3. in proviso to sub-rule (1), for the words "shall also include the names", the following words shall be substituted, namely:-
  4. "shall also include the validity of the lease and the names";

  5. after sub-rule (1), the following sub-rule shall be inserted, namely:-
  6. "(1A) The Central Government may by general or special order issued from time to time, specify the period of validity of registration of the aircraft.";

  7. sub-rule (6), the following sub-rule shall be substituted, namely:-

"(6) The registration of an aircraft registered in India may be cancelled at any time by the Central Government, if it is satisfied that -

    1. such registration is not in conformity with the provisions of sub-rule (2); or
    2. the registration has been obtained by furnishing false information; or
    3. the aircraft could more suitably be registered in some other country; or
    4. the lease in respect of the aircraft registered in pursuance of sub-clause (iv) of clause (a) of sub-rule (2), is not in force; or
    5. the aircraft has been destroyed or permanently withdrawn from use; or
    6. it is inexpedient in the public interest that the aircraft should remain registered in India."

 

(2) in rule 33, Clause (d) shall be omitted;

(3) Rule 34 shall be omitted;

 

Note:

  1. The principal rules published in the Gazette of India, Part I, dated 27th March, 1937 vide notification No.V-26, dated 23rd March, 1937 and subsequently amended by:-

    1. GSR 1202 dated 23.7.1976, published in Part II, Section 3, sub-section (i) of the Gazette of India 14.8.1976.
    2. GSR 36 dated 7.1.1992, published in Part II, Section 3, sub-section (i) of the Gazette of India 25.1.1992.
    3. GSR 349 (E) dated 31.7.1997, published in Part II, Section 3, sub-section (i) of the Gazette of India 2.8.1996.

  1. The Central Government in exercise of the powers conferred in proviso to section 14 of the Aircraft Act,1934 (XXII of 1934) has dispensed with the condition of previous publication in case of this notification vide its Order No. AV.11012/007/97-A dated 14th July, 1997 issued in Ministry of Civil Aviation.
